    Acceptable Use Policy

    This Acceptable Use Policy ("AUP") is incorporated by reference into the LearnSpark.io Terms of Service and governs your use of the Service. Your use of the Service is subject to this AUP.

    1. Prohibited Uses

    You may not use the Service to engage in, foster, or promote illegal, abusive, or irresponsible behavior, including:

    • Illegal Activities: Any activity that is illegal under applicable law.
    • Harmful Content: Content that is defamatory, obscene, abusive, invasive of privacy, or otherwise objectionable.
    • Infringement of Rights: Infringing the intellectual property or other proprietary rights of others.
    • Spam: Sending unsolicited bulk messages or promotions.
    • Security Violations: Gaining unauthorized access to any system or network.
    • Interference: Interfering with the proper working of the Service or any activities conducted on the Service.

    2. Content Standards

    You are solely responsible for any and all content you upload, post, or otherwise transmit via the Service. You agree not to post content that:

    • Is false, misleading, or inaccurate.
    • Is fraudulent or deceptive.
    • Promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group.

    3. Lesson Recording (Spark Insights)

    The Spark Insights feature must only be used for its intended educational purpose: recording a lesson so LearnSpark can generate feedback and personalize the next lesson. You may not use Spark Insights to:

    • Record any individual (adult or child) who has not been informed that the session is being recorded.
    • Record conversations in violation of any applicable recording, wiretap, all-party consent, or privacy law in your jurisdiction.
    • Record a child without the authority of that child's parent or legal guardian.
    • Capture conversations that are not part of an educational lesson (e.g., private family discussions, third-party phone calls, workplace conversations).
    • Attempt to extract, export, or repurpose recorded audio or transcripts outside the Service in ways that would violate the rights of any participant.

    Full recording terms, retention rules, and participant-consent responsibilities are set out in Section 7 of our Terms of Service and Section 3.5 of our Privacy Policy.

    4. Fair Use for Unlimited Accounts

    Some LearnSpark plans or private offers may be described as "Unlimited." Unlimited access is designed to give one family flexible, generous use of lesson plan generation, learning support tools, and related features for genuine family or home education use.

    Normal family use includes:

    • Creating lesson plans for children in your household.
    • Adapting lesson plans for different ages, levels, subjects, and learning needs.
    • Regenerating, editing, or refining lesson plans as needed.
    • Using LearnSpark regularly as part of your family's home education rhythm.

    Unlimited access does not include:

    • Sharing one account across multiple households.
    • Using one family account for a school, tutoring business, learning centre, co-op, microschool, paid teaching service, or other organization unless LearnSpark has agreed this in writing.
    • Creating content for children who are not part of your household unless LearnSpark has agreed this in writing.
    • Reselling, republishing, or packaging LearnSpark-generated materials as your own commercial product.
    • Automated, bulk, scripted, or unusually high-volume generation.
    • Use that places unusual strain on the Service or falls outside normal family learning needs.

    If usage appears unusually high or outside the intended purpose of the plan, LearnSpark may contact you to understand how the account is being used. We may ask you to adjust usage, move to a more suitable plan, or, in cases of misuse, limit, suspend, or terminate access.

    "Unlimited" means you can use LearnSpark freely and confidently for your family's learning. It does not mean unlimited commercial, institutional, shared, automated, or abusive use.

    5. Enforcement

    We reserve the right, but do not assume the obligation, to investigate any violation of this AUP or misuse of the Service. We may:

    • Remove, disable access to, or modify any content or resource that violates this AUP.
    • Suspend or terminate your account for any violation of this AUP.

    6. Reporting Violations

    If you become aware of any violation of this AUP, you agree to immediately notify us and provide us with assistance, as requested, to stop or remedy the violation. To report any violation, please contact us at: [email protected]
